How court decides spousal support

When determining spousal support (also known as alimony), the court will take many factors into account. The “supporting” party indicates the primary earner in the household, whether that person be male, female, or other. Below are just a few important aspects the court considers: 

  • The length of the marriage—ten years is a common line between a “long” marriage and a “short” marriage

  • Each party’s assets and earnings

  • Whether the supported party paid for the education or training of the supporting party

  • The ability of the supported party to profitably work while caring for children in their custody

  • The age and health of each party

  • Any criminal convictions
